Failure to Disclosed Branded Title

California law requires dealers to disclose any branded title before selling a used vehicle. Title brands indicate prior damage, defects, or use that affect a vehicle’s value or safety. Dealers must also disclose out-of-state branding and provide access to a National Motor Vehicle Title Information System (NMVTIS) report before the sale.

Depending on the brand, a warning label may be required to be affixed on the vehicle.

Included California DMV Branded Titles

DMV branded titles include: Salvage, Revived Salvage, Lemon Law Buyback, True Mileage Unknown (TMU), Original Taxi, Original Police, Non-USA (Grey Market), and Remanufactured.

Out-of-state brands like Flood, Junk, or Rebuilt are usually reclassified as Salvage in California and must still be disclosed. Failure to do so may violate California Vehicle Code, the Consumer Legal Remedies Act, and other laws.
